Terms of service
Plain English. If anything below seems unfair to a small business owner, email hello@mellon.chat and we'll talk about it.
1. Who we are
ChatBooker (we / us) is an Australian-built AI receptionist service. The legal entity operating the service is currently registered in NSW, Australia. By signing up you agree to these Terms and our Privacy Policy.
2. What you get
A 24/7 AI receptionist that handles messages over WhatsApp and SMS, books appointments to your calendar, sends reminders, and recovers no-shows. The exact feature set depends on the plan you're on — see the pricing page.
3. Founding-member offer + guarantee
The founding-member plan ($97/mo AUD) comes with a 10-bookings-or-money-back guarantee: if ChatBooker doesn't put at least 10 paid bookings into your calendar in the first 30 days that wouldn't have come in otherwise, we refund every cent you paid. To claim, email hello@mellon.chat within 14 days of day 30, with evidence (your booking list before + after). We process refunds within 7 business days.
4. What you can't do
- Send spam. We enforce per-recipient rate limits and TCPA-style consent rules. If you try to push around them, we'll suspend your account.
- Use ChatBooker for prohibited content under Twilio's Acceptable Use Policy (e.g. SHAFT-class content, illegal goods).
- Resell the service or whitelabel it without a written agreement.
5. Cancellation
Cancel any time from your dashboard or by emailing us. Cancellation takes effect at the end of the current billing period — no claw-back. We don't pro-rate refunds outside the founding-member guarantee.
6. Service availability
We target 99.5% uptime on the AI receptionist + dashboard. We do not guarantee Twilio's, OpenRouter's, or Supabase's uptime — they're upstream providers and we route around outages where we can. If we cause a sustained outage (more than 4 hrs in a billing month) we'll credit your next month proportionally.
7. Data + ownership
Your business data — conversations, contacts, bookings, settings — is yours. You can request a full export at any time by emailing us. Closing your account deletes everything within 30 days unless you ask us to keep it.
8. Liability
We do our best to keep the service running and reliable, but we're a small business and cannot accept liability beyond the amount you've paid us in the past 3 months. We will never claim a missed booking, no-show, or AI hallucination was somehow your fault — that's on us to engineer around — but we can't be on the hook for indirect / consequential losses (loss of profits, business interruption).
9. Changes to these terms
If we change anything material we'll email you at least 14 days before it takes effect. Continued use after the change means you accept it. If you don't, you can cancel and we'll refund any remaining prepaid time.
